False Names and Identity Theft ? North Carolina Criminal Law

[Editor's note: Regular readers will notice two changes to the blog today. One, for the first time, my posts have a byline. Two, a photograph of the author now appears next to each post. Both changes are intended to make it more obvious who wrote what, so that questions and comments can be accurately directed, and blame and credit can be appropriately attributed.]

Under G.S. 14-113.20, our identity theft statute, it is a felony to use ?identifying information of another person? in order to make fraudulent financial transactions or to ?avoid[] legal consequences.? So, for example, it would be illegal for you to use my credit card number to order some new shoes from Zappos, because credit card numbers are ?identifying information.? G.S. 14-113.20(b)(5).

A question that I?ve had several times is whether a person?s name is ?identifying information.? The issue seems to arise most often when a person is stopped by police, is asked to identify himself, and gives another person?s name, perhaps because giving his real name would allow the police to discover that the person is the subject of an outstanding arrest warrant. It certainly seems that the person is attempting to avoid legal consequences, but is he using ?identifying information of another person? in order to do so? In other words, may he properly be charged with identity theft?

I tend to think so, although the answer isn?t completely clear. To some, it may seem obvious that a person?s name is quintessential ?identifying information.? After all what is more often used to identify a person than his or her name? But ?identifying information? is a statutorily defined term, so the proper analysis starts not with common usage but with the definition of ?identifying information? in G.S. 14-113.20(b). The term is defined as including a list of fourteen items, including things like social security numbers, bank account numbers, and passwords. The list specifically includes ?electronic mail names,? ?digital signatures,? and ?[p]arent?s legal surname prior to marriage,? but it doesn?t include ?names? generally, and none of the enumerated items fit the false name scenario above.

However, the statute also contains G.S. 14-113.20(b)(10), a catchall provision that includes ?[a]ny other numbers or information that can be used to access a person?s financial resources.? A person?s name can be used to access their financial resources, so it seems to fit within the catchall. The counter-argument is that when the General Assembly chose to include ?electronic mail names,? ?digital signatures,? and ?[p]arent?s legal surname prior to marriage? within the definition of ?identifying information,? it implicitly chose not to include names more generally, so the catchall should not be interpreted in a way that is inconsistent with that choice.

I tend to think that a person?s name is ?identifying information? because it falls within the catchall, based mainly on the plain language of the statute and slightly, by analogy, on the federal identity theft statute, 18 U.S.C. ? 1028, which defines ?means of identification? to include a person?s name. I think that the argument about the General Assembly?s implicit exclusion of names generally is too speculative. But I?m sure that others view the issue differently, perhaps including some of my colleagues. The court of appeals expressly declined to decide the issue in State v. Barron, __ N.C. App. __, 690 S.E.2d 22 (2010).

Finally, I should note that the conduct in the example clearly constitutes resisting, delaying, or obstructing an officer, so it is certainly criminal, whether or not it amounts to identity theft.

Google seems to be going out of their way not to promote Disco, the group messaging app built by Google's Slide team. When we first revealed the existence of the iPhone app and website (at disco.com) in March, Google wouldn't comment on it. A few weeks ago, they released an Android version of the app as well. A Full Sized House for Lego Loyalists and a Lego Replica of Settlers of Catan

When you have three boys (as I do), there?s a high probability that your house will contain at least a few hundred Lego building bricks. We may have closer to ten thousand. Our collection started when my oldest son was a kindergartner. He?s due to graduate from high school in a few weeks. A dozen years of Lego collecting can add up. Factor in his two brothers, dozens of birthdays and holidays, and we?re talking massive quantities of the brick.

I give you this history to help you understand why I was so blown away when I heard about James May?s Lego House. Now my kids have built Lego houses before. We even had a 2 foot square replica of Wal-Mart (complete with nail salon and auto center) sitting in our toy room at one point. But when James May (the guy from Top Gear) decides to build a Lego house, he means a real Lego house. Like the kind you live in.

Back in 2009 Mr. May was doing a series of TV shows called Toy Stories, that celebrated classic children?s toys. This is when he decided to go all out and build himself a two story home. He didn?t want to just build squares, he wanted a building that looked like a house, complete with details like tea pots on the kitchen counter and a kitten on the bed.

Weekend Cooking is open to anyone who has any kind of food-related post to share: Book (novel, nonfiction) reviews, cookbook reviews, movie reviews, recipes, random thoughts, gadgets, fabulous quotations, photographs. It is hosted by Beth Fish Reads.

I had a nice time shopping in Utrecht (the Netherlands) with my friend M. last week. I bought some pots for preserving jam and some plant pots for in the garden.

Of course, we needed our coffee at eleven and looked around for a nice place to go. Somehow, we drifted away from the main eating and drinking area (although not too far) and ended up at De Rechtbank (The Courthouse), which is attached to a 4-star hotel so it?s bound to serve quality coffee and food.

To give this post a bookish angle: the book I had been reading was about food and the writer (in the part that I read just the day before) mentioned how bad the food was at De Rechtbank! But then, he was there some years ago when they had just opened. For interested Dutch readers, the book is Keukenprins?by Ronald Giphart.

My friend and I decided to give the place a chance and, with another bookish twist to the story, when we entered I noticed Utrecht?s most famous living poet sitting at one of the tables.

Now the food. We ordered?cappuccino and asked?what types of cake there were to go with our coffees. We were given the choice of Swartzwalder Kirsch (a German cake with cherries and chocolate), a lemon meringue cake, apple cake, and carrot cake.

Now, the interesting thing was, while the lemon meringue cake was called ?citroentaart? and the apple cake ?appeltaart?, i.e., by their Dutch names, the carrot cake was announced as ?carrot cake?.

While we were eating the absolutely delicious carrot cake (generously sized and moist, a far cry from the dry stuff that you sometimes get in inferior establishments) I considered why the waiter had called it carrot cake?rather than the Dutch worteltaart.

The answer? We don?t eat vegetables in our cakes! Eeek!?

When I first lived in England (where I lived for a long time before heading back to the Netherlands) and was introduced to carrot cake, I really didn?t believe this would be nice. But it was! In fact, now it?s one of my favorite cakes. There is absolutely no taste of any carrot in this cake, but the presence of the vegetable makes the cake moist and sweet. Even if you dislike carrots, you?re likely to love this cake.

In the Netherlands, calling a rose a rose by an English name, makes it less a rose. In other words, using an English word rather than a Dutch word means people have to translate the name first, and it just doesn?t sound quite as bad. Those beautiful orangy thingies that the English call carrots,?in your cake? Why not? But wortels, that you use in hotpot and other dinner recipes? No way!!!

So, I take it this is a trick to make Dutch people eat carrot cake. Call it by the English name and it sounds more posh and less ? vegetablish!

Jones has to rehab his hand so that he can fight Evans, if he gets through Davis.They are so focused on each other that they may forget the task at hand.
