Prosecutor reviewing facts in Georgia gym mat death


MACON, Ga. (AP) — A federal prosecutor said Thursday that he is conducting a formal review of facts and evidence in the death of a teenager whose body was found inside a rolled-up wrestling mat in his high school gym.

U.S. Attorney Michael Moore said that if he uncovers sufficient evidence to warrant a criminal civil rights investigation into the death of Kendrick Johnson he will ask the FBI to conduct it.

"I will follow the facts wherever they lead. My objective is to discover the truth," Moore said.

Moore said he's reviewing a previous investigation by a sheriff's office and two autopsies done on Johnson, along with photos, videos and other evidence and information. He said he's met with investigators and the attorneys for Johnson's family.

"I am committed to doing everything in my power to answer the questions that exist in this case, or as many of them as we can," Moore said.

The 17-year-old's body was found Jan. 11 stuck in an upright mat in the school gym after his parents reported him missing the night before. Lowndes County sheriff's investigators concluded Johnson died in a freak accident, but his family insists that someone must have killed him.

David S. Weinstein, a formal federal prosecutor now in private practice in Miami, said it's relatively unusual for federal authorities to go in and review an investigation once a local jurisdiction has closed it.

"There must be something in the information that was provided to him that led him to believe he needed to take another look at it," he said of Moore. "There must have been something that didn't pass the smell test."

Federal jurisdiction is relatively limited and federal authorities will only be able to open a criminal civil rights investigation if they find evidence that a law enforcement officer or someone acting as a law enforcement officer was involved in wrongdoing in the case. If they find, for example, that another person was responsible for a cover-up in the case, they would have to refer that evidence to local authorities to pursue, Weinstein said.

A southern Georgia judge on Wednesday ordered authorities to release all surveillance video that investigators reviewed. Johnson's father said after that ruling that he hoped the footage would contain clues about how he died.

Sheriff Chris Prine had previously released surveillance footage that showed Johnson entering the school gym the afternoon before his body was found. No one appeared to follow him inside.

Johnson's parents wanted to see video from the gym from the hours before their son entered until his body was discovered the next day. The sheriff had declined to release the footage without a court order because it shows other minor students who could be identified.

Johnson's body was stuck upside down in the middle of a wrestling mat that had been rolled up and propped upright behind bleachers.

The sheriff has said he suspects Johnson became trapped trying to retrieve a shoe that fell into the center of the large, rolled mat. A Georgia Bureau of Investigation medical examiner concluded that he died from positional asphyxia, meaning his body got stuck in a position in which he couldn't breathe.

Johnson's family had his body exhumed over the summer so they could get a second opinion from a private pathologist. Dr. William R. Anderson issued a report in August saying he detected hemorrhaging on the right side of Johnson's neck. He concluded the teenager died from blunt force trauma near his carotid artery and that the fatal blow appeared to be non-accidental. A lawyer for Johnson's parents filed court papers last week requesting that a judge order Lowndes County Coroner Bill Watson to hold a coroner's inquest after Watson declined the family's request to do so.

An attorney for Johnson's parents said in September that the autopsy's findings had been sent to local authorities and to Moore, as well as to the Civil Rights Division of the Justice Department.

The Georgia Bureau of Investigation has said it stands by the findings of the initial autopsy. The Justice Department said at the time that it had reviewed the state investigation file and didn't see "sufficient indication of a civil rights violation to authorize a civil rights investigation." But the Justice Department did say it was working with Moore and that his office was monitoring and evaluating the situation.

UK's top court: OK for hospital to stop treatment

(AP) — Britain's highest court has ruled in favor of a hospital that gained court approval to withhold treatment from a terminally ill man despite the family's opposition.

In a unanimous judgment handed down on Wednesday, the Supreme Court ruled that the Court of Appeal was correct in allowing Aintree University Hospital in Liverpool to withhold treatment from David James, 68, who suffered colon cancer, organ failure and a stroke, among other problems.

James' doctors estimated he had a 1 percent chance of survival and applied to the Court of Protection for a legal declaration allowing it to discontinue some types of treatment, like restarting his heart if it stopped and a kidney replacement therapy. The court rejected the application on Dec. 6, but 15 days later the Court of Appeal reversed the decision. By that time, James' condition had worsened, and he died on Dec. 31.

Until his death, James had been dependent on a breathing machine, had a tube to provide him with basic nutrition and hydration. His doctors said "daily care tasks" caused him pain and suffering.

James' family argued that his care should have continued.

The Supreme Court judges concluded that where treatment is futile, "it would be in the best interests of the patient to withdraw or withhold life-sustaining treatment," even if this results in the patient's death.

James' family said they believed he would have wanted to continue being treated and that he had not reached the point where treatment was hopeless. But lawyers for the hospital said James had severe physical and neurological damage, was steadily deteriorating and that further invasive treatments would put him at greater risk.

"When you can't consent, the law says we only treat you when it's in your best interests," said Penney Lewis, a professor and medical law expert at King's College London. She said British courts have previously ruled that preserving life is not always in the patient's best interests and that judges must weigh whether treatment would have any benefit for the patient, even if it doesn't cure them.

Though some treatments which result in minimal improvement might be considered worthy for some patients, such as those in intensive care, Lewis said that criterion wasn't met in James' case by the time the case went to the Court of Appeal, which ruled he had no chance of improving.

"The time had indeed come when it was no longer premature to say that it would not be in his best interests to attempt to restart his heart should it stop beating," the judges wrote in their decision.

Morning Report: Tito Ortiz plans on returning to training six weeks after fracturing neck


Forced to pull out of Bellator's inaugural Pay-Per-View event after fracturing his neck last week, Tito Ortiz says he plans on returning to action sooner than some believed possible.


"Ppl I will have 100% recovery & will be back n the gym in 6 weeks," Ortiz posted to Twitter. "I'm a fighter & I love competition. I was doing great n training but accident do happen. Just time to reshuffle the deck & deal another hand. #positiveminded"


Ortiz, of course, was originally slated to face fellow former UFC light heavyweight champion Quinton Jackson in the main event at Bellator 106 on Nov. 2, the promotion's first foray in PPV. With Tito removed, Jackson was shifted to a later card where he'll face former UFC heavyweight Joey Beltran. Bellator 106, no longer a PPV, will now be headlined by the lightweight title rematch between champion Michael Chandler and Eddie Alvarez.


At 38, Ortiz has had a trying past few years. With just a single win in nine tries dating back to 2006, many are left wondering what would be left to prove.

MMA's Scariest Situations: A Halloween Themed Article (Perhaps?)



Halloween is my least favorite holiday, and I don't know what would come in second. This is an odd way to start an article about being scared, true. But I detest it. I think it brings out the worst in people, especially in regards to the whole trick-or-treat culture. You have kids running full speed in the dark and shoving other kids out of the way to get first dibs on the prime candy spots; you have lazy, absentee parents "taking" their kids trick-or-treating (when all they're doing is inching up the street in their cars, making it impossible to drive); worst of all, you have people pretending to be someone else and pretending to scare other people, which is an affront to all those special folks doing those things for real the other 364 days of the year. It's kind of like New Years Eve, where all those non-drinkers have a few whiskey sours and end up passed out in their neighbors flower bed singing "Bennie and the Jets" and vomiting at the same time. Simply put, it's amateur hour.


That being said, I'm trying to get into the spirit, because I have children in my life. You don't want to be an ogre, because that energy rubs off on kids. Since I can't figure out how to transition from opining on Halloween to opining on things about MMA that would scare the shit out of me if I was forced to experience them ... well, here are some things about MMA that would scare the shit out of me if I was forced to experience them.


Getting into a leglock battle with a Japanese guy.


One of the most important adages in life, "never play footsies with a Japanese guy" is right up there with "never play cards with anyone who has the same first name as a city". It's just a bad idea. You're scrambling, you think you have something, and next thing you know, you're tapping rapidly. Actually, I just thought of a better one ...

Good morning, fellow political junkies.


It's the last week of October. That means the administration has just a month to meet its self-imposed deadline to have the Affordable Care Act website running as efficiently as it and millions of Americans had originally envisioned.


But the first item in our Monday political mix of some of the more interesting items indicates why setting such a deadline might be easier than meeting it.


  • The part of the Affordable Care Act's back-star-crossed office technology that was thought to be working well experienced problems Sunday reports Reuters' David Morgan and Sharon Begley.

  • President Obama apparently didn't know until this summer that the NSA was electronically eavesdropping on leaders of U.S. allies but ordered a halt to that spying once he learned of it, The Wall Street Journal's Siobhan Gorman and Adam Entous report.

  • Budget negotiations between the Democratic-controlled Senate and Republican-led House start this week with low expectations for the sides to reach any significant deficit-reduction agreement since they're so far apart on entitlement cuts and tax increases. The National Journal's Billy House compares the competing budget proposals.

  • Who knew? The Pentagon has a 92-year old futurist nicknamed "Yoda" who runs a Defense Department outfit whose value to the nation is hard for outsiders to determine because it's output is so classified. In a delicious Washington irony, it's difficult for budget cutters to assess the Office of Net Assessment for sequester purposes. Yoda and his operations also have heavy duty political support, the Washington Post's Craig Whitlock reports.

  • More than half the economists surveyed by USA Today said the federal government's partial shutdown hurt economic growth to the point where they are significantly adjusting downward their economic growth forecasts for the next two quarters, report Paul Davidson and Barbara Hansen.

  • A year after Superstorm Sandy destroyed and damaged tens of thousands of coastal homes and businesses in New Jersey and New York, rebuilding is uneven, reports NPR's Joel Rose on Morning Edition. Meanwhile, the high costs of insurance and reconstruction have led to wealthier buyers snatching up properties that once belonged to middle class families, reports The Wall Street Journal's Josh Dawsey.

  • In polling is accurate, Democrat Bill De Blasio, an unabashed liberal, appears poised to win the New York City mayoral election by the widest margin for a non-incumbent since 1973 the New York Times' David W. Chen and Megan Thee-Brenan report.

  • Vice President Biden, political animal that he is, appears to be reveling in his key role in the effort to recruit Democrats to run for Congress, reports Politico's Edward-Isaac Dovere. Not only does Biden help the party in its uphill battle to retake the House but he gets to reenergize connections in states that could be important to him if he decides to run for president.

Contractor warned health site had limited testing

WASHINGTON (AP) — A major contractor behind the federal health insurance exchange website told the government last month it didn't have enough time to test its product.

CGI Federal also told the Centers for Medicare and Medicaid Services in a memo that it couldn't get access to computer logs that would have pinpointed potential problems. The contractor labeled that issue as "severe" as recently as June, and said a compressed schedule didn't allow enough time for adequate testing.

The House Committee on Oversight and Government Reform asked CGI Federal for the documents last week. It released them to the public late Tuesday.

The HealthCare.gov website is a key part of President Barack Obama's health care overhaul, but its high-profile failures have marred the site since it launched Oct. 1.

Apple plays defense and offense with free software, upgrade strategies


Apple's decision to give away OS X upgrades and other software, including the iWork productivity suite, stemmed from both offensive and defensive strategies, analysts said today.


And it puts the ball in Microsoft's court for a response.

"Apple's concerned about the enterprise and Windows 8, where software selection is still largely in the hands of IT managers," said Carolina Milanesi of Gartner. "Apple wants to keep its sweet spot in the enterprise, and counter moves by Microsoft to try and slow the iPad influx there."


Those moves by Microsoft include the Redmond, Wash., company's Surface tablet push, an aggressive pitch that the devices make more productive tools for business than the iPad, and the bundling of a scaled-back version of Office with the Surface 2, the $499 tablet that runs Windows RT.


"It's defensive in that respect," said Milanesi of free iWork with new iPads and iPhones, "to get users to be more engaged with their devices."


Apple's banking on the continued trend of BYOD, for "bring your own device," the shift toward employees making hardware choices for themselves rather than letting centralized IT decide what they use. By putting iWork on every new device, Apple's strategy is to garner grassroots support from their customers, who ideally will not only continue to purchase Apple hardware, but also tell their IT departments that Microsoft's Office suite isn't required on every device.


Office on every device is Microsoft's past-present-and-future strategy, best evidenced by Office 365, a subscription that lets businesses and consumers put Office on up to five mobile devices and five PCs or Macs assigned to an employee or owned by a family.


Anything Apple can do to disrupt Microsoft's business model, Cupertino will count as a win, said Patrick Moorhead, principal analyst with Moor Insights & Strategy. "It's an opportune time to catch Microsoft off-base. Apple would like to disrupt [Microsoft] before it gets to a more service-oriented model," said Moorhead, who saw Apple's free software push as an offense-minded, long-term strategy.


From his perspective, Apple is leveraging the trend toward free in mobile, where operating system updates are free and apps are, if not free, either start out that way -- with in-app purchases driving revenue -- or come at low cost.


"Apple's turned to the mobile phenomena, where the expectation is that software is basically free," said Moorhead. "Microsoft currently charges for major [OS] upgrades, but over the long term, that's going to make Microsoft's business model look odd and strange and expensive."


Perception is everything, Moorhead stressed. If consumers and businesses are constantly reminded that Apple provides free software, free services and free upgrades, eventually that will sink in, and make those same people wonder why Microsoft is asking for payment, even if, as he and Milanesi quickly acknowledged, iWork is not Microsoft Office.


"PC software and services like Windows upgrades and Office will continue to look more expensive year after year," Moorhead said in a piece published on Techpinions.com last week.

10 common tasks for MongoDB



My company has been big into MongoDB over the past year. We've seen all kinds of MongoDB projects that we or our partners have worked on, so I figured it was worth stuffing them into a top 10 list, with the intent to enlighten those who still want to know which tasks might be best handled by the document flavor of NoSQL databases. The jobs we've encountered break down along these lines:


1. Profiles of people
Yes, LDAP is fine for identity when you're authenticating or authorizing, but what about profiling things or people that aren't strongly associated with the system? What about criminal records or child support suspects or customer rewards? What about users of promotions and what they clicked on? There's always new data to add to the user's profile, from the usual top-level stuff (phone, address, email, etc.) to information a layer below (i.e., phone type). Other database types haven't evolved fast enough to capture the hundred ways we contact each other or the dozens of ways we pay for things.

2. Product/catalog data
Way back when, I worked for a cell phone manufacturer (or two) and later a chemical company. Each had a weird version of the same problem: Products were composed of other products, and which products those were composed of changed over time and tended to have more than one brand or identifier. Capturing the thing that contains the thing that contains the thing is much simpler in a document database than in some other database types.


3. Geospatial data
This isn't necessarily because MongoDB is a great document database, but because it has specific geospatial features. Either way, MongoDB is your friend, whether you're calculating your bike ride distance or figuring out geospecific information about your customers.


4. Funds, mutual funds, etc.
The finance industry is complicated, so don't make it more complicated than it needs to be. Investment vehicles often are composed of other investment vehicles, which are then composed of other investment vehicles. Whether this is a "bandwidth" fund or a mutual fund or a fund of funds, if you're trying to perform while flattening the data out, you may suffer. Heck, the industry is full of documents that contain documents that contain documents, so why not use a document database?


5. Metadata
As Forrest Gump said, "it happens," and then you have lots of it. You need to categorize and say what "it" is like. MongoDB does this well. There are other database types that will also work (i.e., graph databases), but MongoDB is a fine choice.


6. Talk
People are social creatures, and over the last decade or so we've generated exabytes of social data. Mongo is a fine choice to handle the load. Often, people talk topically, with a lot of associated metadata. MongoDB is good for storing that too.


7. Content
They don't call MongoDB a "document" database for nothing. It's great for serving up text and HTML, as well as for storing and indexing content and controlling its structure.


8. Games
You have to water those flowers or serve those restaurant patrons or grow your vegetables or kill zombies or whatever. Games have goals, which consist of multiple objectives obtained through achievement or paying your way out. Whether it's a titanium rake or a BFG 9000, MongoDB can handle the concurrency and save the (often multi-level) data.


9. Events
MongoDB may not be the only game in town with regards to event logging, but it's a perfectly good choice that won't slow you down.


10. Bills/invoices
Orders have line items containing product data. The order is also sent to a location and billed to another location. This is how it is and always has been. Orders also progress through many states. You might freak over the idea of a NoSQL database doing "transactions," but Mongo can perform these as discrete operations if you've properly designed your document. MongoDB can handle the concurrency, can efficiently "add one more," and can track the changes as the bill of sale moves through the system.

UFC welterweight contender Johny Hendricks suffered second-degree burns while shooting commercial for UFC 167 last month

You may have seen the UFC's slick new commercial for next month's UFC 167 event (if not, view it below), headlined by welterweight champion Georges St. Pierre defending his belt against top contender Johny Hendricks. There's a cool soundtrack, slow motion punches and flashy lights that were apparently placed too close to Hendricks and which gave the challenger second-degree burns.

Hendricks' manager Ted Ehrhardt told MMA Fighting that the lights used to film the commercial were placed too close to the fighter and they burned through his skin. As a result, Hendricks missed days of training while his skin healed.

"Ehrhardt said Hendricks tried to resume his training two days later, however, the burn was bothering him too much so he went to a doctor who prescribed an ointment to help heal it. Ehrhardt said Hendricks, who wasn't available to speak about the incident, missed one-to-two days of training, and the injury healed in a week.

'Johny never gets pissed off about anything,' Ehrhardt said. 'He was just mad that it was messing up his training, that's all.'"

Ehrhardt also said that the UFC apologized to Hendricks for the incident and the former national champion wrestler did not ask the promotion to pay for any of his medical expenses related to the burns. By the way, Ehrhardt says that Hendricks never gets sun burns in the summer time so, you know, those lights were pretty bright.

Fighters often talk about how promotional duties to hype fights can get in the way of the training they need to do in order to be ready to fight on game night. Hendricks may have just beaten all other fighters for promotional-related nuisances.

Remember, Hendricks won't be simply boxing at UFC 167 - he'll be fighting mixed martial arts against a man who is primarily known for his grappling and wrestling. Chances are, a big part of St. Pierre's strategy will be to put Hendricks on his recently burned back.

That's not really fair, but who should be blamed at this point and is there anything that could be done, short of postponing the match up and effectively ruining the UFC's 20th anniversary show. Hendricks himself has not yet commented on the situation and it isn't known if he ever considered pulling out of or postponing the fight because of his burns.

Hopefully Hendricks' bosses over at the UFC will throw some extra discretionary cash his way to begin to make up for his medical costs and, perhaps most importantly, his lost time training for the biggest fight of his career.

NYC council votes to make tobacco-buying age 21

(AP) — Smoking may be a bad habit — but New York City lawmakers want their residents to be older and wiser before deciding to take it up.

The New York City Council voted overwhelmingly Wednesday to raise the age for purchasing cigarettes from 18 to 21, a move that would make the nation's most populous city among only a handful in the United States to target young smokers by barring them from buying smokes. It also approved a bill that sets a minimum $10.50-a-pack price for tobacco cigarettes and steps up law enforcement on illegal tobacco sales.

"This will literally save many, many lives," said an emotional City Councilman James Gennaro, the bill's sponsor, whose mother and father died from tobacco-related illnesses. "I've lived with it, I've seen it ... but I feel good today."

Mayor Michael Bloomberg, who is a strong supporter of the tough smoking restrictions, has 30 days to sign the bills into law. The minimum age bill will take effect 180 days after enactment.

"We know that tobacco dependence can begin very soon after a young person first tries smoking so it's critical that we stop young people from smoking before they ever start," Bloomberg said in a statement.

With Wednesday's vote, New York is by far the biggest city to bar cigarette sales to 19- and 20-year-olds. Similar legislation is expected to come to a vote in Hawaii this December. The tobacco-buying age is 21 in Needham, Mass., and is poised to rise to 21 in January in nearby Canton, Mass. The state of New Jersey is also considering a similar proposal.

Lawmakers who pushed for the change cite city statistics that show youth smoking rates have plateaued at 8.5 percent since 2007.

"We have to do more and that's what we're doing today," said City Council Speaker Christine Quinn. "We have a real chance of leading the country and the world."

The city's current age limit is 18, a federal minimum that's standard in many places. Smoking in city parks and beaches is already prohibited as it is in restaurants.

Advocates say higher age limits help prevent, or at least delay, young people from taking up a habit that remains the leading cause of preventable deaths nationwide.

Smoker Stephen McGorry, 25, agreed with that view as he took a drag outside a midtown Manhattan bar.

"It just makes it harder for young people to smoke," said McGorry, who started lighting up at 19. He added that had the age been 21 when he took up the habit, "I guarantee I wouldn't be smoking today."

But cigarette manufacturers have suggested young adult smokers may just turn to black-market merchants. And some smokers say it's unfair and patronizing to tell people considered mature enough to vote and serve in the military that they're not old enough to decide whether to smoke.

"New York City already has the highest cigarette tax rate and the highest cigarette smuggling rate in the country," said Bryan D. Hatchell , a spokesman for R.J. Reynolds Tobacco Company, which makes Camel and other brands. "Those go hand in hand and this new law will only make the problem worse."

A coalition of bodegas and tobacco store owners funded by tobacco-manufactures also slammed the council's vote Wednesday, particularly the bill that sets the minimum prices and bans tobacco product discounts and coupons.

Ramon Murphy, president of the Bodega Association of the U.S., said the new rules will drive people to illegal sellers who do not care about the age of their buyers.

Another anti-smoking initiative pushed by the Bloomberg administration was previously shelved ahead of Wednesday's vote.

The mayor proposed in March a bill modeled on laws in Iceland, Canada, England and Ireland to require shops to keep tobacco products in cabinets, drawers, under the counter, behind a curtain or in other concealed spots until a customer asked for them. He said the displays "invite young people to experiment with tobacco."

But a similar measure had been rescinded in suburban Haverstraw, N.Y., after cigarette manufacturers sued. They said it violated their companies' free speech rights to communicate with consumers about their products' availability and prices.

The city Health Department said in a statement that the measure was taken off the table because "with the arrival of e-cigarettes, more time is needed to determine how best to address this problem."

E-cigarette makers say their products are healthier than tobacco, and a trade association leader bristled at the city's proposal to prevent people under 21 from buying them.

"Is 21 the right number? People can join the Army at 18," said Ray Story, founder of the Atlanta-based Tobacco Vapor Electronic Cigarette Association.

Newsstand clerk Ali Hassen, who sells cigarettes daily to a steady stream of customers from nearby office buildings, said he didn't know if the new age restrictions would do any good.

While he wouldn't stop vigilantly checking identification to verify customers' age, Hassen doubted the new rules would thwart determined smokers.

"If somebody wants to smoke, they're going to smoke," he said.

Online Advice Can Hurt Teens At Risk For Suicide, Self-Harm

If you're wondering how to conceal the wounds caused by cutting, a form of self-harm, the Internet can tell you how.


"Those long gloves, the cool stripey ones that cover half your arms, could help," advises one post on an online forum.


But that same post offered advice on how to avoid self-injury, including briefly dipping one's face in a bowl of ice water to short-circuit the urge. "I know it's very difficult in times of stress not to SI, but reach out for any help and support that's there, and try other positive techniques to lengthen the space between the urge and wanting to SI," the post reads.


That tension is evident in a review published Wednesday that tries to nail down how Internet forums and other online venues influence young people's risk of suicide and self-harm.



Social media and online groups can provide support for young people at risk of self-harm and suicide, the review finds. But they can also increase the risks, the review says, exposing teenagers to cyber-bullying and endorsements of self-harm.


The assessment is a little squishy, mainly because there haven't been many solid studies conducted. Researchers at the University of Oxford found 14 studies worldwide that carried some weight. Five found negative effects from online activity; they were also the higher-quality studies. Seven found positive influences, and two were undecided.


The studies found a strong link between online forums and increased risk of suicide, a risk not found with other forms of social networking. In one study, 60 percent of the 429 participants said they had learned suicide techniques online. In another study, 80 percent of teenagers who had seriously injured themselves said they had gone online to research self-harm.


Young people who were online for more than five hours a day were more vulnerable to being influenced by information in favor of suicide or self-harm, the review found.


Suicide is a leading cause of death among teenagers and young adults, with about 4,600 lives lost each year, according to the Centers for Disease Control and Prevention.


And though the studies found evidence both for good and harm online, they by and large didn't look at online resources designed to prevent suicide and self-harm, such as the National Suicide Prevention Lifeline.


"That was surprising," says Paul Montgomery, a professor of psycho-social intervention at the University of Oxford and an author of the study, which was published in the online journal PLOS ONE.


Some countries have become so alarmed by cyberbullying and pro-suicide sites that they have shut them down, Montgomery says, citing Australia as one country that has gone that route.


"I can see that policymakers might grasp at straws," Montgomery tells Shots. "But we have to think about prevention, and the Internet does present us with opportunities."


Internet forums run by health care workers, he points out, could be one way provide support at a time when people are most vulnerable.

“Happy Ending, Right?”

A Stanford MBA named Roy Raymond wants to buy his wife some lingerie but he's too embarrassed to shop for it at a department store. He comes up with an idea for a high-end place that doesn't make you feel like a pervert. He gets a $40,000 bank loan, borrows another $40,000 from his in-laws, opens a store, and calls it Victoria's Secret. Makes $500,000 his first year. He starts a catalog, opens three more stores, and after five years he sells the company to Leslie Wexner and the Limited for $4 million. Happy ending, right? Except two years later, the company's worth $500 million and Roy Raymond jumps off the Golden Gate Bridge. Poor guy just wanted to buy his wife a pair of thigh-highs.

In this scene, Zuckerberg has just asked Parker why his girlfriend looks so familiar; turns out the woman on Parker’s arm is a Victoria’s Secret model. Parker, founder of Napster (and the first president of Facebook), is impressing upon young Zuckerberg that the true genius behind what he calls a “once-in-a-generation-holy-shit idea” isn’t necessarily the idea itself, but the insight, drive, and perseverance to see just how far the idea can go. There’s no better example to prove his point than the story of Raymond, Wexner, and Victoria’s Secret.












In the mid-1970s, Roy Raymond did indeed walk into a department store to buy his wife lingerie, only to find ugly floral-print nightgowns—made even uglier under harsh fluorescent lights—and saleswomen who made him feel like a deviant just for being there. Realizing that other male friends felt the same way, the 30-year-old saw an opportunity to create a market where none existed: A lingerie store designed to make men feel comfortable shopping there.










Raymond imagined a Victorian boudoir, replete with dark wood, oriental rugs, and silk drapery. He chose the name “Victoria” to evoke the propriety and respectability associated with the Victorian era; outwardly refined, Victoria’s “secrets” were hidden beneath. In 1977, with $80,000 of savings and loans from family, Raymond and his wife leased a space in a small shopping mall in Palo Alto, Calif., and Victoria’s Secret was born.










To understand how novel Raymond’s idea was, it helps to have a little context. In the 1950s and ’60s, underwear was all about practicality and durability. For most American women, sensual lingerie was reserved for the honeymoon trousseau or the anniversary night; Frederick’s of Hollywood was the granddaddy of the specialty lingerie retailers. When the women’s movement of the late 1960s and ’70s called for women to liberate themselves from the bondage of bras, the intimate apparel industry responded with new designs that they claimed would give women the natural look they desired without the embarrassment of a sagging bustline. But for the most part, underwear remained functional, not fun.










Victoria’s Secret changed all that, and in the Bay Area, its sales continued to boom—thanks in large part to its catalog, which reached customers across the country. Within five years, Raymond had opened three more stores in San Francisco. By 1982, the company had annual sales of more than $4 million—yet something in Raymond’s formula was not working. According to management experts Michael J. Silverstein and Neil Fiske’s book Trading Up, Victoria’s Secret was nearing bankruptcy.










Enter Leslie Wexner, the man who had ushered in the mass-market sportswear boom with a store he called The Limited. While still in his 20s, Wexner had recognized that women were forgoing dresses for separates and casual wear. So in 1963, he opened a store “limited” just to sportswear. Wexner’s foresight paid off. The Limited grew to 11 stores by 1970, and 188 by 1977, according to a Forbes profile published that year. Wexner, now 40, was worth $50 million.

Referees need to be willing to stop fights if UFC’s spotless safety record is to continue

In that euphoric moment when a fighter who, seconds before, had been virtually out cold, rallies to win a significant bout, no one is thinking of concussions or traumatic brain injuries or Chronic Traumatic Encephalopathy (CTE) or subdural hematomas or death.

They're too busy cheering the stunning turnaround, hailing a fighter who was victorious against almost invincible odds.

There have been many such miraculous comebacks in the UFC, one of the reasons we've fallen so deeply in love with the sport. Cheick Kongo scored a win out of nowhere over Pat Barry in a fight in Pittsburgh's Consol Energy Center which he was seconds away from losing by knockout.

Frankie Edgar rallied to retain his lightweight title after being dropped multiple times and on the verge of going out against Gray Maynard at UFC 125. Tim Boetsch was battered and beaten and hopelessly out of the fight when he came out of nowhere to defeat Yushin Okami at UFC 144.

There have been no deaths in the cage in the UFC's 20-year history, and, as best as is known, none of its fighters have suffered traumatic brain injuries.

This is due in large part to safety procedures set in place before a card begins. Fighters are thoroughly checked medically before they're cleared to fight.

Doctors, paramedics and ambulances are on hand at every arena to treat fighters in distress.

UFC fighters are among the greatest sportsmen in the world, as Lyoto Machida showed on Saturday when he failed to take advantage of an out-cold Mark Munoz in the main event of a card in Manchester, England. Machida knocked Munoz down with a kick to the head, and got to the prone Munoz before the referee.

The rules allowed Machida to try to punch the downed Munoz -- What ex-heavyweight champion Randy Couture called the sport's "rules of engagement" after a loss to Brock Lesnar at UFC 92 -- but Machida recognized Munoz was out and defenseless and never threw another punch.

The referee then quickly stopped the fight. By declining to throw that extra punch or two before the referee intervened, Machida may have saved Munoz a serious brain injury.

Brian Stann did the same thing in a fight last year with Alessio Sakara. Their restraint, and that of numerous other fighters who have reacted similarly when they realize the opponent is helpless, has been another factor why there haven't been any deaths or traumatic brain injuries.

Much of the credit for the UFC's terrific safety record, though, should be given to the referees, who very literally have the fighters' lives in their hands, and repeatedly show good judgment.

But once in a while, a fight goes on too long and a debate is stirred. It's happened in the last two UFC shows. Many were critical of referee Herb Dean for not stopping the heavyweight title fight between Cain Velasquez and Junior dos Santos at UFC 166 in Houston earlier.

Velasquez was pummeling dos Santos from the bout's opening seconds, and by the end of the third round, there were calls for Dean to stop the bout. But Dean let dos Santos continue until the fifth, when dos Santos went down and Velasquez delivered a series of unanswered blows from the top.

On Saturday in Manchester, Jessica Andrade routed Rosi Sexton in a fight that referee Neal Hall let go the three full rounds. Many thought it should have been stopped, including UFC television analyst Joe Rogan. Sexton, though, took a shot at what she felt was Rogan's over-the-top commentary.

48 hours post fight - I have 2 black eyes, otherwise I'm 100% fine. You could have given me an IQ test as I stepped out of the cage, and I'd still have scored higher than Joe Rogan.

Long-time MMA journalistDamon Martin suggested in a column on Fox Sports that Hall made the right move allowing the fight to continue.

He suggested gender bias led to all the calls for a stoppage, when there were not similar cries when males were being similarly beaten.

If the conversation is about when a fighter is being too tough for their own good or when to account for too much punishment in a fight, then that's a subject worth putting under the microscope but it has to go there without an ounce of gender bias. Referees and corners need to undergo training and watch fight footage and have to understand when enough is enough and be willing to make those calls regardless of the public backlash that may occur because a fight was deemed as stopped too early.

The same goes for corners who are there on behalf of the fighters, and they need to be willing to stop the action and deal with the fallout from fellow coaches and the fighter for making a judgment call.

The problem with Martin's thinking is that while someone may have made an error by not stopping a previous fight, the same error shouldn't be repeated, because there can be dire consequences to allowing a fighter to take too many blows to the head.

"Big" John McCarthy, the outstanding referee, made a great point to Ben Fowlkes in USA Today about the right time to stop a fight. The referee's job is all about safety and not about worrying about what is at stake for a fighter.

If the fighter doesn't show he is physically able to be competitive and defend himself, the bout needs to be stopped, no matter what is on the line. McCarthy was 100 percent on the money in his comments to Fowlkes.

No one deserves the right to finish a fight. They earn it through their actions in being competitive. A ref needs to understand the difference between fighting and surviving. Sometimes we need to protect fighters from themselves as much as their opponent.

I have personally covered seven boxing matches where a fighter died, and in virtually every case, it wasn't from one single powerful punch. Rather, the death resulted from a long, sustained beating to the head.

Sexton finished on her feet and, fortunately, appears to be in good health. And, as Martin pointed out correctly, she had her best round in the third after being demolished in the second.

Stopping a fight too quickly may rob the fans of a Kongo over Barry or of Boetsch over Okami or one of any of about 100 other incredible finishes.

That, though, is what must be done to ensure as best as possible a fighter does not wind up with a serious, life-altering brain injury.

The referee should always stop a bout when one fighter is taking repeated, clean, hard blows to the head and doesn't seem to have the capacity to fend off further onslaughts by either landing significant strikes of his or her own or by strategically moving away from danger.

CTE and other traumatic brain injuries don't go away just because a fighter rallied from the brink of defeat for a heart-pounding win. Referees must be trained to stop fights well before there is a higher-than-average risk of head injury.

Doing so will occasionally rob the fans of an amazing stop-the-presses finish, but if it means all of the fighters return home safely with their wits intact, it's a small price to pay.

Mozilla releases 10 patches, five critical, for Firefox


Mozilla released 10 patches for three versions of its Firefox browser on Tuesday, five of which are considered critical and could be used to remotely install malicious code.


The U.S. Computer Emergency Readiness Team warned that the problems "could allow a remote attacker to execute arbitrary code, bypass intended access restrictions, cause a denial-of-service condition or obtain sensitive information."

The Mozilla products affected are Firefox 25, Firefox ESR 24.1, Firefox Extended Support Release (ESR) 17.0.10, Thunderbird 24.1, Thunderbird ESR 17.0.10, and Seamonkey 2.22.


Among the flaws fixed were several memory safety bugs in the browser engine, which is also in Mozilla's Thunderbird email client and Seamonkey, a suite of applications and web development tools.


Those bugs, tagged as update MFSA 2013-93, "showed evidence of memory corruption under certain circumstances, and we presume that with enough effort at least some of these could be exploited to run arbitrary code," according to Mozilla's advisory.


The other four critical vulnerabilities could cause potentially exploitable crashes, Mozilla said.


One of the vulnerabilities given a "high" risk rating, MFSA 2013-99, could divulge information on a computer's local system. A security researcher, Cody Crews, discovered "a method to append an iframe into an embedded PDF object rendered with the chrome privileged PDF.js."


"This can used to bypass security restrictions to load local or chrome privileged files and objects within the embedded PDF object," Mozilla wrote.


In August, the TOR project warned that a vulnerability in Firefox ESR may have been used to collect information on computers visiting websites configured as TOR hidden services.


TOR, short for The Onion Router, is a system that allows for more anonymous browsing by routing encrypted requests for websites through servers worldwide. The TOR Project distributes a Browser Bundle, which includes Firefox for browsing with TOR.


The vulnerability could have facilitated the execution of remote code, but instead may have been used to collect the hostname and MAC address of Windows computers, it said. The TOR Project typically updates its browser bundle package quickly after Mozilla releases new patches.
